Kalabahi,metroalor.com Badan pertanahan Nasional(BPN) Kabupaten Alor mengadakan sosialisasi dan pelatihan dalam rangka internalisasi pembangunan zona integritas kepada seluruh pegawainya di hotel simponi pada 4/10/22.
Kepala BPN Alor ,Jose Marcus Fernando, S.SiT. SH, MPA dalam sambutan pembukaan mengatakan, reformasi birokrasi merupakan salah satu upaya pemerintah untuk mencapai good govermance (pemerintah yang bersih) untuk melakukan penataan terhadap sistim penyelenggaraan pemerintahan yang baik, efektif dan efisien sehingga dapat melayani masyarakat secara tepat dan profesional, tandas Jose.
Sejalan dengan hal tersebut kata Jose, pemerintah telah menerbitkan peraturan presiden nomor 81 tahun 2010 tentang Grand design reformasi birokrasi 2010-2025 yang mengatur tentang pelaksanaan program reformasi birokrasi.Peraturan tersebut menargetkan tercapainya tiga sasaran hasil utama yaitu peningkatan kapasitas dan akuntabilitas organisasi,pemerintah yang bersih dan bebas KKN,serta peningkatan pelayanan publik. Maka BPN Alor perlu untuk membangun pilot project pelaksanaan reformasi birokrasi.
Dalam rangka kegiatan internalisasi pembangunan zona integritas melalui kelompok kerja Penguatan pengawasan dan kelompok kerja peningkatan kualitas penangan publik pada kantor BPN Alor bekerja sama dengan instansi terkait yaitu , Kejaksaan negeri Alor, Polres Alor dan BRI cabang Alor, sebagai Nara sumber .
Maksud dan tujuan dari kegiatan sosialisasi dan pelatihan ini anatara lain, sebagai acuan khusus pada kantor BPN kabupaten Alor mereformasi diri dalam menata birokrasi menuju kearah pelaksanaan tata kelolah pemerintahan yang baik ( good govermance) yang bebas dari KKN dengan menciptakan lingkungan positif yang bebas adanya benturan kepentingan dan gratifikasi.
Sedangkan tujuannya adalah memberikan keseragaman pemahaman dan tindakan dalam membangun zona integritas menuju wilayah bebas korupsi (WBK) /wilayah birokrasi bersih melayani (WBBM) dilingkungan kantor BPN kabupaten Alor.
Kepala seksi perdata dan tata usaha negara( kasi Datun) kejaksaan negeri Alor, Kurnia Aji Nugroho, SH. MH dalam paparan materi tentang pengendalian Gratifikasi menjelaskan, hal yang sering terjadi dan sering terjadi dan tidak terhindarkan dalam kegiatan sehari-hari adalah adanya pemberian Gratifikasi dari satu pihak kepada pihak lainnya.
Menurut Aji, pasal 12B ayat (1) undang-undang nomor 31 tahun 1999 tentang pemberantasan tindak pidana korupsi sebagaimana telah diubah dengan undang-undang nomor 20 tahun 2001 dengan tegas menyatakan bahwa setiap gratifikasi kepada pegawai negeri atau penyelenggara negara dianggap pemberian suap ,apabila pemberian tersebut dilakukan karena berhubungan dengan jabatannya dan berlawanan dengan kewajiban atau tugasnya.
“Jika bapak/ibu menerima sesuatu berupa barang atau uang dan vocer belanja atau tiket keluar negeri dari pihak lain segerah melaporkan kepada pihak berwajib salah satunya adalah KPK”, tandas Aji.
Dengan memperhatikan perkembangan modus gratifikasi yang terjadi saat ini dilingkungan pengelola negara, dipandang perlu untuk untuk mengatur hal-hal yang lebih rinci terkait dengan gratifikasi dan tata cara atau mekanisme pelaporannya dilingkungan kantor BPN yang sesuai dengan ketentuan peraturan perundang-undangan dan selaras dengan dengan pedoman prilaku( Cade of conduct) serta nilai-nilai yang berlaku dilingkungan kantor BPN ,terang Aji.
Sementara kasiwas polres Alor, Iptu, Sahlul Tamolung, SH dalam materinya tentang whistleblower dan penanganan benturan kepentingan menjelaskan, whistblower merupakan sebuah proses kompleks yang bertumpu pada keberanian individu atau kelompok untuk memainkan peran sebagai whistblower.
Sahlul juga menyinggung soal gratifikasi seperti yang disampaikan pemateri dari kejaksaan negeri Alor. Dikatakannya, perbedaan antara gratifikasi yang dilarang dan yang boleh diterima . Kalau gratifikasi yang dilarang adalah yang memenuhi kriteria sebagai berikut, gratifikasi berhubungan dengan jabatan .Penerimaan tersebut dilarang oleh peraturan yang berlaku. Bertentangan dengan kode etik, memiliki konflik kepentingan atau merupakan penerimaan yang tidak patut atau tidak wajar.
Kalau gratifikasi yang boleh diterima memiliki karakteristik sebagai berikut, berlaku umum yaitu kondisi pemberian yang diberlakukan sama dalam hal jenis ,bentuk persyaratan atau nilai untuk semua peserta dan memenuhi prinsip dan memenuhi kewajaran atau kepatutan. Dan tidak bertentangan dengan peraturan perundang-undangan yang berlaku.
Landasan hukum dari gratifikasi ,lanjut Sahlul, diatur dalam undang-undang nomor 31 tahun 1999 undang-undang nomor 20 tahun 2001 pasal 12 dimana ancamannya adalah penjara paling singkat 4 tahun dan paling lama 20 tahun dan denda paling sedikit 200 juta rupiah dan paling banyak 1 milyar rupiah.
Pelayanan prima merupakan sebuah bentuk keharusan atau tuntutan dalam instansi pemerintah ketika menghadapai pemohon Pelayanan adalah suatu kegiatan atau urutan kegiatan yang terjadi dalam interaksi langsung antara seseorang dengan orang lain atau mesin secara fisik , dan menyediakan kepuasan pemohon .
Demikian dijelaskan Pemateri ketiga Sandi Ayadhi dari BRI cabang Alor, yang berbicara tentang penerapan budaya pelayanan prima kepada peserta sosialisasi dan pelatihan segenap pegawai BPN Alor .
Secara sederhana kata Sandi, pelayanan prima (Service exccelence) adalah suatu pelayanan yang terbaik dan memenuhi harapan dan kebutuhan pemohon.
